SMS Messaging Program Terms

These SMS Messaging Program Terms (“SMS Terms”) govern your participation in our text messaging program (the “Program”) operated by Alcanza Clinical Research (“we,” “us,” “our”). These SMS Terms are separate from, and in addition to, any other terms of service, purchase agreement, or account agreement you may have with us.
1. Program Description
The Program sends recurring SMS/MMS text messages from Alcanza Clinical Research to mobile numbers that have explicitly opted in. Messages may include:
- Promotional offers, marketing updates, and product news
- Account, order, or appointment notifications
- Customer service replies to inbound inquiries
Message frequency varies based on the messages you have opted in to receive. Messages may be sent on a recurring basis, though frequency may change.
2. How to Opt In
You may enroll in the Program through any of the following methods. Each method requires a clear, affirmative action by you:
- Website form: Submitting your mobile number through our opt-in form at alcanzaclinical.com and checking the unchecked SMS consent box that specifically authorizes us to send Program messages.
- Keyword: Texting the keyword JOIN (or another published keyword) to our short code or long code number from the mobile phone you wish to enroll.
- Paper or in-person form: Providing your mobile number on a written form that contains a clear, separate, and optional consent statement for SMS messaging.
The SMS consent option is always presented separately from any other agreement, and never preselected. You may complete any sign-up, purchase, or account-creation flow without enrolling in the Program.
3. Consent Disclosure at Opt-In
At the point of opt-in, we display the following information:
- The name of the Program and the identity of the sender (Alcanza Clinical Research).
- The types of messages you will receive.
- The statement: “Msg & data rates may apply. Message frequency varies. Consent is not a condition of purchase.”
- Instructions to text HELP for help and STOP to cancel.
- Links to these SMS Terms and to our Privacy Policy.
4. Message and Data Rates
Standard message and data rates may apply to each message sent or received, as determined by your mobile carrier. We do not charge for the messages themselves, but you are responsible for any charges from your carrier. Please contact your carrier for pricing details.
5. Opt-Out / Cancel
You can cancel the Program at any time. Reply STOP to any message you receive from us to opt out. After you send STOP, we will send a single confirmation message and you will not receive any further Program messages unless you opt back in. You may also opt out by contacting us at the address listed in Section 11.
Opting out of one Program does not necessarily opt you out of other unrelated messaging programs you have separately enrolled in. To opt out of all programs, reply STOP ALL or contact us directly.
6. Help
For help with the Program, reply HELP to any message you receive, or contact us using the details in Section 11. Carriers are not liable for delayed or undelivered messages.
7. Eligibility
To enroll in the Program, you must be at least 18 years of age (or the age of majority in your jurisdiction), the account holder or authorized user of the mobile number provided, and a resident of a country in which the Program operates. By opting in, you represent that you meet these requirements.
8. Privacy
We collect and use information you provide in connection with the Program in accordance with our Privacy Policy. We do not sell your mobile number, and we do not share your mobile number or SMS opt-in data with third parties or affiliates for their own marketing purposes. Information may be shared with service providers (such as our SMS platform vendor) solely to operate the Program.
9. Supported Carriers and Devices
The Program is available on most major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages. Service availability and message delivery are not guaranteed and may be affected by factors outside our control, including your device, carrier, and location.
10. Limitation of Liability and Changes
The Program is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties and are not liable for any damages arising from your participation in the Program, including delayed, lost, or undelivered messages. We may modify or terminate the Program, or these SMS Terms, at any time. Material changes will be communicated to enrolled participants where required by law. Continued participation after a change becomes effective constitutes acceptance of the revised SMS Terms; if you do not agree, reply STOP to opt out.

12. Governing Law
These SMS Terms are governed by the laws of the jurisdiction in which Alcanza Clinical Research is established, without regard to its conflict of law provisions. Nothing in these SMS Terms limits any rights you may have under applicable consumer-protection or telecommunications laws.
